1. THESKINNYSCOOP: The SkinnyScoop LLC, dba theSkinnyScoop, offers the “TADA! SHOP ANSWER A QUESTION” (“Contest”) pursuant to these Rules.

2. ENTRY: During the period beginning at 12:01 P.M., Monday June 14, 2010, and ending at 12:00 pm on Friday June 18, 2010 (“Entry Period”), you may enter this Contest by ANSWERING ONE QUESTION ON THESKINNYSCOOP: WHAT ARE YOU MOST LIKELY TO SPLURGE ON FOR YOUR KIDS? For purposes of these Official Rules (“Rules”), all times and days are in the Pacific time zone.
(a) Only registered users of theSkinnyScoop are eligible to win.
(b) Winners will be chosen by theSkinnyScoop, in its sole discretion. When you answer this question on theSkinnyScoop site (active members only), you will be entered into a drawing for one grand prize from Tada! Shop (a $100 gift card to Bella Bliss).
(c) It is your sole responsibility to notify theSkinnyScoop in writing if you change your email address (“Address”), as this is the only method we will use to communicate with you about this Contest.

3. LIMITATIONS: Contest is open from 12:01 P.M. on Monday, June 14, 2010 to 11:59:59 A.M. on Friday, June 18, 2010. Only one Entry per person or Address (regardless of whether one person has more than one Address or more than one person use the same Address) will be accepted. In event of a dispute regarding the identity of the person submitting an Online Entry, the Entry will be deemed to be submitted by the person in whose name the account is registered. Entries by any method other than set forth above in Section 3 are void. Any use of automated or programmed methods of effecting Entry is prohibited. Open only to persons who are 18 or older upon start of the contest. Employees of theSkinnyScoop, and the members of their households and members of their immediate families, are all ineligible to participate in the Contest. Neither theSkinnyScoop, nor any of its officers, directors, shareholders, employees, agents or representatives (individually and collectively, “Releasees”) are responsible for any contest entries that are altered, delayed, destroyed or irregular in any way, or otherwise not in compliance with these Rules; or for other errors of any kind, whether due to electronic, mechanical or human error or other causes; even if caused by the negligence of any of the Releasees. Any such potential entries will be disqualified. Any attempt by a person to use multiple email accounts to register more than once may result in disqualification. Void where prohibited or restricted by law.

4. PRIZES: GRAND PRIZE: A total of one Grand Prize Package of a Tada! Shop gift pack will be awarded to one individual. All other expenses not specifically mentioned herein are not included, and are solely the winner’s responsibility. Limit one prize per person/Address per calendar year. Any depiction of prize is for illustrative purposes only. Prizes are not redeemable for cash or transferable. No substitution allowed except, at theSkinnyScoop’s sole discretion, a prize of equal or greater value may be substituted. Prizes cannot be used in conjunction with any other promotion or offer. Prize elements may not be separated.

5. PROCEDURES: All prizes will be awarded provided at least five registered users participate, and prizes are validly claimed by Friday, June 25, 2010, after which no alternate winners will be selected nor unclaimed prizes awarded. Contest will be conducted during the Entry Period. On or about Friday, June 18, 2010, in a random drawing, the potential winners will be selected from all eligible Entries received. Odds of winning depend on the total number of eligible Entries received.

6. WINNERS: Potential winners will be notified by email on or about Monday, June 21, 2010. At the sole discretion of theSkinnyScoop, disqualification, forfeiture and the selection of an alternate winner may result from any of the following: [1] potential winner’s failure to respond to notification within ten (10) days after its mailing/transmission; [2] the return of any notice or prize as undeliverable; [3] potential winner’s failure to provide theSkinnyScoop with satisfactory proof that he/she is the authorized account holder of the Address associated with any winning registered user; [4] potential winner’s failure to provide theSkinnyScoop with satisfactory proof of age, identity and residency; [5] potential winner’s failure to validly claim any prize before Friday, June 25, 2010; and [6] any other non-compliance with Rules or any applicable law or regulation. In the event of a prize forfeiture, the TheSkinnyScoop may, in its sole discretion, award or not award the forfeited prize to an alternate winner. All taxes are solely the responsibility of each winner.

7. PRIVACY POLICY/DATA COLLECTION: Information provided by you for this Contest is subject to theSkinnyScoop’s privacy policy located at :www.theskinnyscoop.com/privacy.

8. CONDITIONS: By entering this Contest, you agree, represent and warrant that: [1] you agree to the Rules and theSkinnyScoop’s decisions with respect to the Contest, which shall be final in all respects; [2] anything submitted in relation to any Contest entry becomes solely theSkinnyScoop’s property and will not be acknowledged or returned; [3] you release and hold harmless the Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Contest or any Contest-related activity or travel or from any interaction with, or downloading of, computer Contest information; [4] the prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); [5] any winner’s acceptance of any prize constitutes the grant to TheSkinnyScoop and assigns of an unconditional right to use winner’s name, address (city and state or province only), voice, likeness, photograph, biographical and prize information and/or statements about the promotion for any publicity, advertising and promotional purposes without additional compensation; [6] in the event unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the theSkinnyScoop’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Contest, so that it cannot be conducted as originally planned, TheSkinnyScoop may, in its sole discretion, modify the Rules or cancel, modify, terminate or suspend the Contest; and in such event, may select any winners, if any, by such method as theSkinnyScoop in its sole discretion shall consider equitable; [7] the Releasees are not responsible for typographical or other errors in the offer or administration of this Contest, including but not limited to: errors in the advertising, Rules, selection and announcement of the winners and distribution of the prizes; [8] any portion of any prize not accepted or used by any winner will be forfeited; [9] theSkinnyScoop has the right, at any time and at its sole discretion, to disqualify any individual it suspects: to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Contest; or (b) violating theSkinnyScoop’s Rules, Terms of Service or Privacy Policy; [11] theSkinnyScoop may take all steps necessary to corroborate any information provided to theSkinnyScoop by the Participants; [12] any and all disputes, claims and causes of action at law or in equity (“Claim”) arising out of or relating to this Contest, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of California, and shall be solely and exclusively brought in the state or federal courts within that state; [13] any Claims shall be resolved individually, without resort to any form of class action; [14] any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and any and all rights to have damages multiplied or otherwise increased.
